The Albanese Government's joint media release of 15 July 2026 set out new Australian Standards for AI, including legal obligations for large data centres to underwrite new renewable power supply, pay their own grid connection costs, reduce power on demand and operate with water efficiency.[4] Legislation formalising those obligations is not expected until early 2027.
That gap has a measurable shape. Twenty-five data centres already approved but not yet built, totalling at least 2.9 GW of planned capacity, look set to escape the incoming rules entirely.[6] Prime Minister Anthony Albanese said the new rules would apply to future proposals only: "This will be for new proposals. You can't retrofit."[5] Greens senator Sarah Hanson-Young has called for the rules to apply retrospectively to those 25 approved centres, a position the government has not accepted.[6] Data Centre Australia chief executive Belinda Dennett said operators cannot design to standards that have not yet passed parliament.[6] The largest wave of AI infrastructure investment in Australia's history is advancing ahead of the policy framework intended to govern it, with legislation targeted for the first quarter of 2027.
