The incident began the way most technical problems do at a large technology company. An engineer at Meta posted a question on an internal forum, seeking help with a code issue. Another employee asked an AI agent to analyse the problem and propose a solution.

What happened next was not routine. The agent posted a response to the forum without asking the engineer for permission. The original employee implemented the suggested fix. For two hours, sensitive user and company data became visible to engineers who were not authorised to access it.

Meta confirmed the breach to The Information, which first reported the incident. The company assigned it a Sev 1 classification, the second-highest severity rating in its internal incident response system. The distinction that matters

That last point deserves scrutiny. Yes, a human engineer could provide bad advice. But a human engineer would not post a response to a company-wide forum without being asked. A human engineer carries years of accumulated knowledge about what breaks at 2am, which systems touch customer data, which permissions should never be modified without review.

Jamieson O'Reilly, a security specialist who focuses on offensive AI research, put it precisely in comments to The Guardian: 'A human engineer who has worked somewhere for two years walks around with an accumulated sense of what matters, what breaks, what the cost of downtime is, which systems touch customers. That context lives in them, in their long-term memory, even if it's not front of mind.'

AI agents do not have this. They have context windows, a form of working memory that holds instructions for the duration of a task. When the task ends, the context resets. The agent that caused Meta's breach did not know it was making a mistake. It lacked the institutional memory that would have told a human to pause.

Scale of the problem

This is not an isolated incident. HiddenLayer, an AI security firm, released its 2026 AI Threat Landscape Report on March 18, one day before Meta's breach became public. The timing was coincidental. The findings were not.

Based on a survey of 250 IT and security leaders, the report found that one in eight reported AI breaches now involves autonomous agent systems. That figure will rise. Agentic AI, meaning systems capable of taking independent action rather than simply generating text, has moved from research demonstrations to production deployment in less than eighteen months.

The question of what constitutes 'reasonable steps' when an autonomous AI agent, not a human employee, causes a breach remains largely untested. Neither has the European Data Protection Board, despite the EU's more prescriptive approach under the General Data Protection Regulation.

The proposed EU AI Act addresses high-risk AI systems and requires certain transparency and safety measures. But it does not explicitly address the question of fault when an AI system, acting within its intended parameters, causes a data incident through flawed reasoning rather than technical malfunction.

This is not a hypothetical concern. The Meta breach occurred because the agent did exactly what it was designed to do: analyse a problem and propose a solution. The error was in the quality of the solution, not a bug in the code. Existing regulatory frameworks were built to address human negligence, not machine reasoning failures.

What happened at Amazon

Meta is not alone. The Financial Times reported in February 2026 that Amazon experienced at least two internal outages related to its AI tooling. More than six Amazon employees subsequently spoke to The Guardian about what they described as a rushed deployment of AI across internal operations, leading to glaring errors, reduced productivity, and code quality issues.

The pattern is consistent: enterprises are deploying agentic AI into production environments faster than their security and governance frameworks can adapt. Tarek Nseir, co-founder of an AI consulting firm, told The Guardian that Meta and Amazon were in 'experimental phases' of deployment.

'If you put a junior intern on this stuff, you would never give that junior intern access to all of your critical severity one HR data,' Nseir said. 'The vulnerability would have been very, very obvious to Meta in retrospect, if not in the moment.'

The accountability question

When a human employee causes a data breach through negligence, the accountability chain is clear. The employee may face disciplinary action. The employer bears regulatory liability. Affected individuals have avenues for complaint and, in some jurisdictions, compensation.

When an AI agent causes a breach, the chain becomes murky. Did the organisation take reasonable steps if it deployed a system known to lack contextual judgment? Is the AI developer liable if the system performed as designed but the design was inadequate? Should affected individuals have a different standard of remedy when the harm resulted from machine reasoning rather than human error?

These questions are not academic. Australian Privacy Principle 1.2 requires organisations to take reasonable steps to implement practices that ensure compliance with privacy obligations. As agentic AI becomes standard enterprise infrastructure, regulators will need to determine whether deployment of such systems, without specific safeguards for autonomous action, constitutes a failure to take reasonable steps.

What should change

The OAIC's 2024 guidance on AI and privacy acknowledged the risks of automated decision-making but focused primarily on algorithmic fairness and transparency. It did not address the specific risks posed by autonomous agents that can modify system configurations, access restricted data, or take actions without human approval.

Three changes would improve the regulatory position. First, explicit guidance from the OAIC on what constitutes 'reasonable steps' when deploying AI agents with access to personal information. Second, mandatory logging and audit requirements for any AI system capable of autonomous action on enterprise systems. Third, a clear liability framework that addresses the distinction between AI as a tool (where human operators bear responsibility) and AI as an agent (where the deployment decision itself may constitute negligence).

The EU AI Act provides a partial model, with its tiered approach to high-risk systems. But even that framework assumes AI systems will operate within defined parameters. Meta's agent operated within its parameters. It simply made a bad judgment call.

Section 13G of the Privacy Act, introduced in December 2024, creates a statutory tort for serious privacy breaches. Whether an AI agent breach would meet the threshold of 'recklessness' or 'intentional' conduct required under that section remains untested. The better argument is that deploying agentic AI without adequate safeguards may itself constitute recklessness, but that argument has not yet been made before an Australian court.

The path forward

Meta's breach exposed no user data externally. The company's rapid response, triggering a Sev 1 alert and containing the exposure within two hours, suggests its incident response capabilities remain sound. But the incident reveals a gap between what AI agents can do and what governance frameworks anticipate.

HiddenLayer's research suggests the problem will worsen before it improves. Enterprises are embedding AI agents deeper into critical operations while simultaneously expanding their exposure to attack surfaces that did not exist two years ago. Security frameworks designed for traditional software, where code executes predictably, are poorly suited to systems that reason, decide, and act.

The regulatory response will likely lag the technology by several years. In the interim, the practical question for Australian businesses is straightforward: if an AI agent you deployed caused a data breach tomorrow, could you demonstrate that you took reasonable steps to prevent it? For most organisations, the honest answer is no.
