TLDR

Meta settled with 51 US attorneys general for up to US$17.1 billion over claims its platforms addicted children, with binding design rules for under-18s. An extra US$5.3 billion depends on TikTok and YouTube matching those restrictions, but TikTok blocked Meta's recruitment ads as prohibited political content.

KEY TAKEAWAYS

01Meta must pay at least US$12.1 billion over ten years regardless of what rivals do.

02An additional US$5.3 billion is contingent on TikTok and YouTube matching Meta's design rules.

03TikTok blocked Meta's recruitment ads in September 2026, classifying them as political content.

04Under the settlement, Meta must enforce two-hour daily caps and block feeds from midnight to 6 a.m. for users under 18.

05Neither TikTok nor YouTube has committed to the framework, leaving the full US$17.1 billion in doubt.

## The deal and what it demands

New York Attorney General Letitia James and a bipartisan coalition of 50 other attorneys general secured a settlement with Meta on 26 August 2026 for up to US$17.1 billion, targeting addictive design on Facebook and Instagram.[\[1\]](https://ag.ny.gov/press-release/2026/attorney-general-james-secures-171-billion-and-groundbreaking-reforms-meta?ref=bushletter.com) The binding design rules are where operators should look first.

Under the settlement, Meta must verify user ages, limit under-18s to two hours per day across Facebook and Instagram, block feeds from midnight to 6 a.m., silence notifications from 10 p.m. to 7 a.m., and mute notifications during school hours on weekdays.[\[2\]](https://oag.dc.gov/release/attorney-general-schwalb-announces-meta-will-pay?ref=bushletter.com) These are enforceable obligations, not product roadmap promises.

"Children in New York and nationwide are suffering while companies like Meta reap immense profits by intentionally addicting them to their social media platforms," James said.[\[1\]](https://ag.ny.gov/press-release/2026/attorney-general-james-secures-171-billion-and-groundbreaking-reforms-meta?ref=bushletter.com) Brian L. Schwalb, Attorney General of the District of Columbia, put it plainly: "Meta intentionally exploited kids for profit and then lied about it, claiming its products were safe when its own internal research confirmed the platforms were addictive and harmful."[\[2\]](https://oag.dc.gov/release/attorney-general-schwalb-announces-meta-will-pay?ref=bushletter.com)

## The conditional $5.3 billion

Meta will pay at least US$12.1 billion over ten years to resolve the multistate lawsuits, with a further US$5.3 billion contingent on TikTok and YouTube adopting comparable child-safety measures.[\[2\]](https://oag.dc.gov/release/attorney-general-schwalb-announces-meta-will-pay?ref=bushletter.com) That conditional tranche is the number worth watching if you want to know whether this settlement reshapes industry behaviour or stays a Meta-specific liability.

Meta's Chief Legal Officer C.J. Mahoney framed the ask directly: "Because teens move fluidly across dozens of apps, we need an industry-wide solution. We therefore call on our industry peers, TikTok and YouTube, to implement this new framework, right away."[\[3\]](https://investor.atmeta.com/investor-news/press-release-details/2026/Metas-Agreement-With-Bipartisan-Attorneys-General-Calling-on-TikTok-and-YouTube-to-Join-Us-in-Supporting-Teens/default.aspx?ref=bushletter.com) Meta's financial incentive here is straightforward: the more platforms that adopt matching rules, the less Meta carries the lone-bad-actor label and the more of that US$5.3 billion flows.

## TikTok's ad block and what it signals

TikTok's response was operational. When Meta ran ads calling on TikTok and YouTube to adopt the framework, TikTok blocked them, classifying the content as prohibited political material under its Politics, Governments, and Elections advertising policy, last updated July 2026.[\[4\]](https://ads-useast2a.tiktok.com/resources/help/article/tiktok-ads-policy-politics-government-and-elections?lang=en&ref=bushletter.com) At minimum, the block tells you TikTok has no appetite for being recruited into Meta's framework on Meta's terms.

Neither TikTok nor YouTube has committed to the settlement's design rules, so the US$5.3 billion conditional payment stays locked.

## The Australian comparison

Australia's Online Safety Amendment (Social Media Minimum Age) Act 2024, enacted on 10 December 2024, obliges platforms to take reasonable steps to prevent children under 16 from creating accounts, with civil penalties of up to 30,000 penalty units for non-compliance. The Online Safety (Age-Restricted Social Media Platforms) Rules 2025, in force since 31 July 2025, cover platforms with recommender systems or login requirements and empower the eSafety Commissioner to monitor enforcement and impose penalties of up to AUD 49.5 million for ongoing breaches.

What Australia's regime does not include are the hourly caps or overnight feed blocks that Meta is now legally required to enforce in the United States. Age assurance is mandated; time limits are not. Critics including Electronic Frontiers Australia have argued that verifying age means identifying everyone, not just children, and that giving the eSafety Commissioner broad notice and penalty powers without prior judicial oversight creates a structural chilling effect on lawful speech and small publishers.

The eSafety Commissioner's September 2025 guidance puts platforms including Facebook, Instagram, Snapchat and TikTok on notice to implement age-assurance measures and report compliance. Whether the Commissioner will move to incorporate time-cap or night-mode requirements modelled on the US settlement remains open as of 26 August 2026.

FREQUENTLY ASKED QUESTIONS

How much does Meta have to pay under the settlement?

Meta must pay at least US$12.1 billion over ten years to 51 US attorneys general. A further US$5.3 billion becomes payable if TikTok and YouTube adopt matching child-safety design rules, bringing the potential total to US$17.1 billion.

What design rules must Meta now enforce for users under 18?

Meta must verify user ages, cap daily use at two hours across Facebook and Instagram, block feeds from midnight to 6 a.m., silence notifications from 10 p.m. to 7 a.m., and mute notifications during school hours on weekdays.

Why did TikTok block Meta's ads?

TikTok classified Meta's recruitment ads, which called on TikTok and YouTube to adopt the settlement framework, as prohibited political content under its Politics, Governments, and Elections advertising policy.

How does Australia's social media law compare to the US settlement?

Australia's law requires platforms to prevent under-16s from creating accounts and mandates age assurance, but does not impose hourly usage caps or overnight feed blocks. The US settlement goes further on design restrictions while Australia's regime focuses on account access.
